Terms of Service

These Terms of Service govern your use of CountMyDay, including the web application, and any paid or free services we make available. By accessing or using the service, you agree to these Terms and our Privacy Policy. If you use the service on behalf of a company or other entity, you represent that you have authority to bind that entity.

You must be at least 13 years old to use the service.

You must provide accurate account information and keep your credentials secure.

You are responsible for all activity that occurs under your account unless it results from our own failure to provide reasonable security.

CountMyDay is a daily discipline and habit tracking application. Users can create personal runs, complete daily tasks, track streaks, and participate in group runs with other users. Some features are available only on paid Pro plans. Features, limits, and pricing may change over time.

You retain ownership of content you create on CountMyDay, including run names and task names. You give CountMyDay a non-exclusive, worldwide licence to host, store, reproduce, and display that content only as needed to operate and provide the service. You represent that you have the rights necessary to submit that content.

Do not use the service for unlawful, harmful, fraudulent, or abusive activity.

Do not attempt unauthorised access to other users' accounts or data.

Do not interfere with the security, integrity, or availability of the service.

Do not bypass plan, subscription, or feature restrictions.

Do not upload malicious code or attempt to exploit vulnerabilities.

Paid subscriptions renew automatically until cancelled. By starting a paid plan you authorise us and our payment processor (Stripe) to charge the applicable fees using your selected payment method. You can manage or cancel your subscription at any time through Settings → Billing. Cancellation stops future renewals but does not retroactively refund amounts already paid unless required by law. One-time purchases such as Second Chance are non-refundable once used. We may change pricing with advance notice.

Free accounts are limited to 1 active personal run and do not have access to Group Runs or Analytics. CountMyDay reserves the right to modify free plan limits at any time with notice.

We may suspend or terminate access if we reasonably believe you have violated these Terms, created risk for other users, failed to pay fees, or if we are required to do so by law. You may stop using the service at any time. Provisions relating to payment obligations, disclaimers, limitations of liability, and intellectual property survive termination.

The service, including our software, branding, and product design, is owned by CountMyDay or our licensors and is protected by applicable intellectual property laws. You may not copy, distribute, modify, reverse engineer, or create derivative works from our protected materials without permission.

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, uninterrupted availability, and error-free operation.

To the maximum extent permitted by law, CountMyDay and its affiliates, officers, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or business opportunities. Our aggregate liability for any claim shall not exceed the greater of the amount you paid us in the 12 months before the claim arose or £10.

We may update these Terms from time to time. If we make a material change we will update the date above and provide additional notice where appropriate. Continued use after the updated Terms take effect means you accept the revised Terms.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
